Dallas
Use classification for The Lone Volt
A custom energy drink bar with counter service and optional lounge seating maps most closely to restaurant without drive-in or drive-through service under Dallas Development Code Ch. 51A-4.209 — permitted in commercial, central area, and most industrial districts.[3]
Important: a City food establishment permit (health) does not determine zoning classification.[4] If alcohol, entertainment, or bar-style revenue dominates, the use may be reclassified as bar/lounge/tavern (75%+ alcohol revenue threshold) — likely requiring a Specific Use Permit (SUP).[3][4]
The Lone Volt as beverage-only (no alcohol) avoids TABC and most bar SUP triggers. Standard afternoon and evening retail hours are unlikely to trigger separate late-hours overlay rules; see neighborhoods below if hours ever extend past midnight.[7][9]
Permits & process (citywide)
| Step | Requirement | Notes for The Lone Volt |
|---|---|---|
| 1. Zoning verification | Confirm base district + any PD/overlay on parcel | Use Sustainable Development / Planner of Day before LOI |
| 2. Plan review | Food Establishment Permit application + $205 plan review (new/remodel)[1] | Submit floor plan, equipment layout, finishes, drains at 320 E. Jefferson Blvd[2] |
| 3. Application fee | $121 application (non-refundable)[1] | Requires TX Sales & Use Tax Permit + photo ID[1] |
| 4. Annual permit | Risk-based: ~$141–$513/yr by sq ft & risk level[1] | 1,200–1,600 sq ft likely Risk Level 1–2 |
| 5. Food manager | Certified food manager required at permit approval[2] | Texas DSHS-approved CFM course |
| 6. Building / CO | Certificate of Occupancy via Building Inspection[2] | Finish-out permit if walls/equipment change |
| 7. Signage | Sign permit via Sustainable Development | Separate from health permit |
Facility requirements (health)
- Handwash sink, 3-compartment warewashing (if reusable utensils), sanitizer, mop sink[2]
- Floor drains / hub drains in prep areas (plan review checks this)[2]
- Commercial refrigeration for concentrates and bottled inventory; ice handling per Texas Food Establishment Rules[2]
- Grease interceptor — confirm with plan reviewer; beverage-only with minimal food may have reduced requirements but many landlords require one in restaurant shells[2]
Deep Ellum
PD 269 Deep Ellum/Near East Side Planned Development District[5]
- Restaurant without drive-in service — permitted by right on Tract A (core Deep Ellum) By right[5]
- Bar, lounge, or tavern — requires SUP SUP[5]
- Parking: In original buildings, no parking required for first 5,000 sq ft of restaurant floor area; then 1 space per 100 sq ft. On-street parking may count. Outdoor seating under certain covers may be excluded from parking calc (up to 50% of interior area).[6]
- Late hours (proposed): As of 2024–2026, city and Deep Ellum Foundation discussed requiring a midnight SUP for businesses operating 12 a.m.–6 a.m. — not yet adopted citywide but actively discussed.[9][10] Relevant only if hours extend past midnight; standard retail hours typically avoid this.
- Noise: Entertainment district; live music venues nearby — expect noise compatibility scrutiny on outdoor speakers and patio use.[9]
Lower Greenville / M Streets
PD 842 Modified Delta Overlay · Late-hours rules apply[8]
- Restaurants permitted by right in PD 842 commercial areas[8]
- Late Hour Establishment: Any retail/personal service open between midnight and 6 a.m. requires a Specific Use Permit — must close by midnight without SUP[7][8]
- Recent SUP examples (e.g., Voodoo Doughnuts) extended hours to 2 a.m. with conditions: max sq ft, customer removal by 2:15 a.m., no outdoor speakers[8]
- If extending hours past midnight → plan SUP application and hearing timeline (3+ months)
Bishop Arts / Oak Cliff
Verify PD Mix of PD districts and traditional commercial (LC, NC)
- Restaurant without drive-through generally allowed in commercial districts per Ch. 51A-4.209[3]
- Bishop Arts has conservation/overlay areas — check for historic facade, sign, and parking restrictions on parcel
- Lower rent than Uptown but smaller foot traffic; same citywide health/permit process[1][2]
- Confirm whether property falls under Oak Cliff special purpose or conservation district (affects demolition, signage)
Design District / Trinity Groves
Mixed zoning Industrial/commercial (IR, LC) and PD tracts
- Restaurant without drive-in permitted in commercial and industrial districts[3]
- Trinity Groves area uses multiple PDs — parking ratios and use tables vary by PD ordinance; do not assume Deep Ellum rules[6]
- Destination dining corridor; less natural evening walk-up traffic than Deep Ellum
- Check DART/I-30 frontage sign ordinances and any design standards in PD documents
Liquor control overlays (if adding alcohol later)
Dallas has D and D-1 Liquor Control Overlay Districts (Ch. 51A-4.503) restricting distance to schools, churches, and other sensitive uses.[11] The Lone Volt MVP is non-alcoholic, but any future energy+cocktail line would require overlay + TABC review.
